These Terms of Service ("Terms") form the legal agreement between you and Kookaburra Health for use of our website and service at kookaburra.health. We've kept this short and in plain English — please read it before you sign up.
1. Agreement
By creating an account, paying for a subscription or report, or otherwise using our service, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, please don't use the service.
If you're using the service on behalf of a company, partnership or other entity, you confirm that you have the authority to bind that entity to these Terms.
2. Who we are
"Kookaburra Health", "we", "us", "our" refers to Principal Podiatry Pty Ltd, trading as Kookaburra Health, an Australian company (ABN 19 615 606 347 · ACN 615 606 347), registered in Queensland with registered office at 14 Sandown Street, Brighton QLD 4017. We are owned and operated by Tradd Horne (AHPRA POD0001880268).
3. What we do
Kookaburra Health provides business intelligence reports and a dashboard for Australian allied health clinic owners. We connect to your practice management system using an API key that you supply, retrieve aggregate and de-identified operational data, and generate quarterly reports that summarise your clinic's commercial and operational performance.
We currently support Cliniko, with additional PMS integrations on our roadmap.
The specific features included in each plan are described on the pricing page on our website. We may add, change, or remove features from time to time and will give you reasonable notice of any material reduction in functionality.
4. Eligibility
- You must be at least 18 years old
- You must be the owner, principal, or an authorised representative of an Australian allied health practice
- You must have lawful authority to connect your practice management system to our service and to share the de-identified data described in our Privacy Policy
- You must not be a competitor of ours signing up to evaluate the service without disclosing that fact
5. Your account
- You are responsible for keeping your account credentials secure. Don't share them. Use a strong, unique password.
- You are responsible for everything that happens through your account, whether you authorised it or not
- Tell us immediately at contact@kookaburra.health if you suspect unauthorised access
- One account per practice. If you operate multiple separate practices, please contact us about a multi-practice plan.
6. PMS API key — your responsibilities
By providing your practice management system API key to us, you confirm that:
- You have lawful authority to grant us access via that key
- You have complied with your obligations under the Privacy Act 1988 (Cth), the Australian Privacy Principles, and any applicable AHPRA codes regarding disclosure to a service provider
- You have updated your practice's privacy collection statement (if required) to reflect the use of an external analytics service
- You will issue a read-only API key wherever your PMS supports that. If read-only keys aren't available, you accept that the key has full account permissions and are responsible for the consequences of that scope.
- You can revoke our access at any time from inside your PMS and from your dashboard with us
We encrypt your API key at rest and use it only for the operations described in our Privacy Policy. We will never use it to write back to your PMS without your explicit per-action consent.
7. Payment and cancellation
Pricing is shown in Australian dollars (AUD) and includes 10% GST where applicable. We offer:
- One-off quarterly report — $245 AUD (single payment, single report)
- Monthly subscription — $99 AUD per month (recurring, includes ongoing quarterly reports and live dashboard access)
All payments are processed by Stripe. We do not see or store your card details.
Subscriptions
- Monthly subscriptions renew automatically on the same calendar day each month, charged in AUD
- You can cancel any time from your dashboard. Cancellation takes effect at the end of your current billing period; we don't pro-rate refunds for partial months unless we agree otherwise in writing
- Failed payments will be retried; if a payment fails three times in succession, your subscription will be paused until you update your payment method
Refunds
- Refund policy: if you cancel within 14 days of your first payment and have not yet received a generated report, we'll refund you in full, no questions asked
- For any other refund request, please contact us — we'll respond within 5 business days and are reasonable about cases where the service hasn't worked as described
- Nothing in these Terms limits your statutory rights under the Australian Consumer Law
Price changes
We may change pricing for new customers at any time. Existing customers on an active subscription will be given at least 30 days' notice before any price increase takes effect, and may cancel without penalty in that window.
8. Acceptable use
You agree not to:
- Use the service for any unlawful purpose or in breach of any Australian or other applicable law
- Attempt to access, probe, or disrupt our systems or other users' accounts
- Reverse engineer, decompile, or attempt to extract our source code
- Scrape, copy, or republish our website content or the contents of your generated reports for resale
- Use the service to compete with us, or to build a competing product
- Upload or transmit content that infringes third-party rights or that constitutes patient data outside the scope described in our Privacy Policy
We may suspend or terminate your account if you breach this section, with notice where reasonable and without notice for serious breaches.
9. Intellectual property
We own (or licence) all intellectual property in the kookaburra.health website, our application code, the design and structure of our reports, and our brand. You receive a non-exclusive, non-transferable licence to use the service for your own clinic's purposes while your account is in good standing.
You retain ownership of your clinic's underlying data. The numbers, charts, interpretations, and recommendations presented in the reports we generate for you are licensed back to you for unlimited internal business use. You may not republish, resell, or distribute the report templates or our analytical methodology to third parties.
10. Not clinical advice
This is the most important section.
Kookaburra Health is a business intelligence tool. It analyses operational and commercial data from your practice management system and produces reports and recommendations aimed at improving the financial and operational performance of your clinic.
Kookaburra Health is not:
- A clinical decision support tool
- A medical device or therapeutic good within the meaning of the Therapeutic Goods Act 1989 (Cth)
- A substitute for clinical judgement, professional advice, or patient consultation
- A claim of any improvement to clinical outcomes
Nothing produced by the service should be interpreted as a clinical recommendation for any individual patient. All clinical decisions remain entirely the responsibility of the registered practitioner, in accordance with AHPRA standards and the relevant board's code of conduct.
11. Service availability and changes
We aim for high uptime but do not guarantee that the service will be continuously available. We may perform scheduled maintenance, and unscheduled outages can occur. We will give you reasonable notice of planned maintenance where practicable.
We may, with reasonable notice, change, suspend or discontinue any part of the service. If we discontinue a paid feature, we will refund the unused portion of any prepayment.
12. Limitation of liability
To the maximum extent permitted by law:
- The service is provided "as is" and "as available"
- We exclude all warranties, conditions, and other terms that are not expressly set out in these Terms
- Our total aggregate liability to you for any and all claims arising from or related to the service, in any 12-month period, is limited to the total amount you paid us in that period
- We are not liable for any indirect, consequential, incidental, or special loss, including loss of revenue, loss of profits, loss of opportunity, or loss of data, even if we have been advised of the possibility of such loss
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right that cannot lawfully be excluded under the Australian Consumer Law.
13. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal costs) arising from:
- Your breach of these Terms or our Privacy Policy
- Your breach of any applicable law, including privacy and health-records laws
- The use of an API key that you were not authorised to share with us
- Any claim made against us by a patient or third party based on something you did or failed to do
14. Termination
You may cancel your account at any time from your dashboard. On cancellation, we will delete your personal data within 14 days, subject to the retention obligations set out in our Privacy Policy.
We may terminate or suspend your account immediately if:
- You materially breach these Terms and don't remedy the breach within 14 days of notice
- Your payment fails repeatedly
- We are required to do so by law
- Continuing to provide the service to you would expose us to material legal or regulatory risk
15. Governing law
These Terms are governed by the laws of Queensland, Australia. Both you and we submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising from or relating to these Terms or the service.
